한국의 민주주의 회복을 위해 박근혜 대통령은 즉각 사퇴해야 한다!

저희는 한국의 민주주의와 정치 변화에 큰 관심을 갖고 염려하는 해외 학자들입니다. 살고 있는 지역과 연구하는 주제는 다양하지만 저희는 하나의 가치를 나누고 있습니다. 그것은 바로 국민들의 수많은 희생과 노력으로 이룩해 낸 한국의 민주주의에 대한 존경과 자부입니다. 그러나 지금 드러나고 있는 박근혜 대통령-최순실 게이트의 실상은 이 사태가 한국의 민주주의와 헌법 질서에 대한 전면적인 도전임을 보여 주고 있습니다. 저희 해외 학자들은 한국 국민들의 깊은 절망을 통감하며, 동시에 전국민적 저항을 통해 표출되고 있는 민주주의 회복의 의지와 열망을 뜨겁게 응원합니다. 저희는 현재 한국 국내 및 해외 여러나라에서 진행되고 있는 박근혜 대통령 퇴진과 한국 민주주의 회복을 위한 운동에 동참하려 합니다.

박근혜 대통령은 헌법이 부여한 대통령으로서의 중대한 권한과 임무를 최순실이라는 일개 민간인에게 위임했습니다. 이것은 대통령의 통치 행위를 아무런 공직을 갖지 않은 일반인에게 제멋대로 맡긴 헌정 파괴 행위입니다. 박근혜 대통령은 최순실과 대통령 비서실을 통해 재벌들로부터 800억에 달하는 불법 자금을 걷어들였습니다. 이는 명백하게 대통령의 권력을 남용한 심각한 부정부패 행위입니다. 박근혜 대통령은 청와대, 국정원, 검찰을 동원하여 언론을 통제하고 여론을 조작했으며 공직과 민간 기관에 자신의 사람들을 임명하고 반대자들을 제거했습니다. 이 또한 권력을 남용하여 민주주의의 기본 질서와 제도를 파괴한 중대한 위법 행위입니다.

박근혜 정권 하에서 언론의 자유는 크게 위축되었고 사상의 자유 또한 심각한 위협에 처하게 되었습니다. 대다수 국민들의 활동과 발언은 블랙리스트로 억누르면서 한 개인에게 특혜를 제공하기 위해 법, 학칙, 원칙, 상식 모두를 무너뜨렸습니다. 관제 데모가 되살아났고 공작 정치도 판을 쳤습니다. 세월호의 진실은 은폐, 왜곡되고 여론은 호도되었습니다. 일본 정부와의 굴욕적인 합의로 위안부 할머니들 가슴에 대못을 박은 것도 모자라 역사 교과서 국정화와 한일 군사정보보호협정 체결을 밀어붙였습니다. 국민의 뜻에 반하기는 사드 배치 강행도 마찬가지입니다. 대북 정책 실패는 남북관계의 균열을 초래했고 그 결과 한반도의 평화가 위협받는 상황으로 내몰리고 있습니다.

이번 위기는 박근혜 한 개인의 일탈　행위의 결과가 아닙니다. 현 정부는 대통령 박근혜의 수족이 되어 부정과 부패의 대리 집행인 역할을 했습니다. 새누리당은 박근혜를 대통령으로 만든 일등 공신이자 대통령의 국정 농단 파트너입니다. 재벌은 이들에게 불법 자금을 지원한 댓가로 온갖 특혜를 받았다는 의혹을 받고 있습니다. 수구 언론은 박근혜 정권과 이들의 비리를 묵인하고 비호하였습니다. 이들은 함께 한국 민주주의를 훼손하고 공권력을 사익 추구에 사용한 공범으로서 대한민국의 주권자인 국민을 조롱하고 기만하였습니다.

이에 저희 해외 학자들은 다음과 같이 요구합니다.
1. 박근혜 대통령은 즉각 사퇴하라.
2. 국회는 즉시 박근혜 대통령 탄핵　절차를 시작하라.
3. 검찰은 박근혜 대통령과 공범들의 불법 행위를 철저히 수사하고 엄중히 처벌하라.
대한민국은 이번 박근혜-최순실 게이트를 한국 정치와 사회, 경제의 민주화를 심화시키는 계기로 삼아야 합니다. 이를 위해 저희 해외 학자들은, 민주화에 대한 열망으로 박근혜 정부와 새누리당, 재벌 및 보수 언론과 맞서 싸우고 있는 한국 국내, 국외의 모든 동포와 함께 박근혜 대통령 퇴진과 한국의 민주주의 회복이 이루어질 그 날까지 끝까지 싸울 것입니다.

President Park must resign immediately!

We are scholars concerned about South Korea's democracy and political change. While we live in different parts of the world and study divergent topics, we share respect for and pride in South Korea's democracy built on Koreans' sacrifice and struggle. We are stunned by the recently-revealed political scandal that President Park Geun-hye and Choi Soon-sil have assaulted the Korea's Constitutional order and democratic principles. We share not only the despair and anger of Korean citizens but also their ardent desire to re-construct Korea's democracy. Today we join them in their struggle to remove Park from the presidency and restore democracy.

President Park Geun-hye has relegated the power and responsibilities that the constitution bestows to the president to her confidante Choi Soon-sil. It constitutes a wanton violation of the constitution to yield the presidential power to a private citizen who holds no public office. President Park deployed Choi and the presidential office to collect illegal fund of 80 billion won from Korea's conglomerates (chaebols), abusing the presidential power to commit a large scale corruption. She mobilized the Blue House, the National Intelligence Service, and the Prosecutor's Office to control the media, manipulate public opinion, appoint their cronies in public and private positions, and remove critics. These actions are nothing but a gross abuse of the presidential power and a serious violation of the rule of law and democratic principles.

Furthermore, President Park has persistently suppressed basic civil liberties such as the freedom of the press and conscience. She has crafted blacklists to stifle dissenting voices while violating the law to grant special privileges to her personal connections. Her regime has sponsored counter-protests against critics and engineered political manipulations. Not only did the government fail to rescue hundreds of passengers from the slowly sinking Sewol, but it has also concealed and distorted the truth about the Sewol tragedy. Park's regime has also angered the nation with a series of measures: it concluded an illegitimate agreement with the Japanese government on "Comfort Women" it is pushing forward the scheme to nationalize history textbooks and it rushed to sign the General Security of Military Information Agreement (GSOMIA) with Japan. Its failed policy toward North Korea has resulted in the breakdown of the inter-Korea relationship and heightened insecurity. It is only exacerbating the situation by recklessly proceeding with the deployment of THAAD against Korean citizens' opposition.

President Park is not the only culprit. Various state institutions and officials have operated as her personal apparatuses to execute corruptions and crimes. The Saenuri Party, too, has colluded with her in her unconstitutional and illegal activities. The chaebols are suspected to have offered illegal political funds in return for the guarantee of special interest. The conservative media has shielded the regime by covering up or remaining silent on their dirty actions. These actors are accomplices who together with Park have undermined democratic rule and abused government authority for private gains.

Park and her party have turned the clock backward, rolling the proud tradition of South Korean democracy back to the dark time of the past authoritarian rule. No longer can we, the scholars abroad who are deeply concerned about Korea's democracy, sit silently watching Park's corruption and authoritarianism. We stand together with the Korean people who are waging a fight against President Park, the Saenuri Party, the chaebol, and the corrupt media in order to restore democracy, fairness, and justice.

We, the undersigned, demand the following:
1. President Park must resign immediately
2. The National Assembly must immediately start the process to impeach the president and
3. The Prosecutor's Office must thoroughly and impartially investigate President Park and her partners in crime, and the Judiciary must impose a maximum penalty on them for their wrongdoings
It is our hope that Korea takes the Park-Choi scandal as an opportunity to deepen democracy in politics, economy, and society. We the undersigned overseas scholars shall stand with the Korean people until President Park resigns and Korea's democracy is restored.

[왜냐면] 또 다른 박근혜를 막아야 합니다

드디어 사임했습니다. 최측근 권력 남용이 문제였죠. 여기에 뇌물 등 여러 혐의가 겹치며 여론이 악화됐고 더는 버틸 수 없었습니다.

2013년 6월 체코에서 있었던 일입니다. 페트르 네차스 총리 최측근이자 연인이었던 나기오바가 이혼 중이던 총리 부인을 감시하기 위해 공권력을 쓴 것이 큰 쟁점이었습니다. 뇌물 등 비리도 있었지만, 권력을 사유화했던 나기오바의 전횡은 공분을 샀죠.

체코 국민의 분노가 이해는 가지만 어디 우리 분노만 할까요. 그 분노는 광장에서 고스란히 드러났습니다. 두 주말 연속 거리로 나온 시민들이 대통령의 하야를 촉구했습니다. 하지만 대통령은 잠을 자는 공주처럼 아무 대답이 없습니다. 이정현 새누리당 대표는 거국중립을 미끼로 시간을 끌고 있죠. 민주당 지도부도 하야, 탄핵, 거국내각 사이에서 갈피를 못 잡고 있습니다.

우리의 분노는 어제오늘의 일이 아닙니다. 공권력 개입으로 선거의 정당성을 훼손했고 오만으로 남북관계의 파탄을 낳았습니다. 무능으로 국정운영은 무너졌고 무관심은 목숨을 앗아가기까지 했죠. 취업률은 갈수록 낮아지고 있고 경제성장률도 크게 둔화했습니다. 언론의 자유는 크게 위축됐고 사상의 자유마저 침해를 받았습니다. 관제 데모가 되살아났고 공작 정치도 판을 쳤죠. 이제 국민이 준 권력을 남에게 던져주고 놀이하듯 사리사욕을 채웠음이 속속 드러나고 있습니다.

그런데 헌법을 통째로 뒤흔든 그런 대통령을 몰아내는 게 이렇게 힘들다는 게 우리를 분노케 합니다. 나라 전체를 혼란에 빠뜨렸지만 몇몇 검사의 판단과 의지에만 기대야 하는 이 현실이 우리를 분노케 합니다. 힘없는 이들은 죽이고 재벌들은 살렸지만 저렇게 당당할 수 있는 대통령의 미소가 우리를 분노케 합니다.

상대적으로 작은 문제임에도 체코 총리가 사임한 데에는 정치체제가 이를 강제했기 때문입니다. 체코도 다른 유럽국가들처럼 비례선거제도와 의원내각제를 바탕으로 민주체제를 운영하고 있습니다. 유권자는 의회선거만 하고 여기서 과반을 얻은 정당 또는 정당 연합이 정부를 꾸립니다. 비례선거 덕에 한 정당이 과반을 차지하는 일은 거의 없으므로 정당 연합이 주로 그 일을 하죠. 이렇게 꾸려진 정부의 수반, 즉 총리는 그 과반의 의석에 의지할 수밖에 없습니다. 과반의 지지를 잃으면 정부가 무너지는 것은 시간문제이니까요.

권력을 잃을 가능성이 제도화돼 있으니 항상 시험 준비를 하는 학생의 마음입니다. 연합 내 소수정당 눈치를 보지 않을 수 없습니다. 체코에서처럼 말이죠. 체코 민심이 싸늘해지자 연합정부를 이루던 다른 정당들로서는 불안했습니다. 그런 총리를 감쌌다가는 앞으로 있을 선거에서 참패할 것이 뻔했고 등을 돌릴 수밖에 없었습니다. 네차스 총리가 인격이 더 훌륭해서 자리에 물러난 것이 아닙니다. 정치체제가 정부 수반을 정치적으로 처벌할 수 있는 스위치를 국민에게 줬기 때문이죠.

박근혜는 곧 물러납니다. 하지만 또 다른 박근혜가 나오지 말라는 법은 없습니다. 이를 예방하고 대응하기 위해서 우리는 정부를 해고할 힘을 가져야 합니다. 지금의 헌법으로는 그럴 힘이 없죠. 개헌해야 합니다. 그 개헌은 의원내각제를 향해야 합니다.

의원내각제가 익숙지 않은 듯하지만 이미 시행했었습니다. 바로 독재자 이승만을 몰아낸 4·19혁명의 기운으로 말이죠. 일인독재를 막기 위해 시작한 의원내각제 민주체제는 일인독재를 꿈꾸던 박정희에 의해 무너졌습니다. 그리고 박근혜는 예를 찾아보기 힘든 유령독재를 만들었습니다. 하지만 덕택에 그 아비가 파괴한 의회주의 전통을 되살릴 기회를 준 셈이죠. 국민의 정부 파면 권력을 되찾을 이 기회를 놓쳐서는 안 됩니다.
